Malpractice risk among US pediatricians

OBJECTIVE

To characterize malpractice risk among US pediatricians.

METHODS

We analyzed malpractice claims of all pediatricians and other physicians covered by a nationwide liability insurer from 1991 to 2005 (n = 1630 pediatricians; 40 916 total physicians). We characterized annual malpractice risk among pediatricians compared with other physicians. We characterized claims according to patient age, injury type, months required to resolve the claim, and whether an indemnity payment was made. We estimated how patient age and injury type were associated with whether a claim resulted in payment to a patient (and if so, payment size) and the time required to resolve the claim.

RESULTS

The annual percentage of pediatricians facing a malpractice claim was 3.1% (7.4% among other physicians, P < .001). Among 404 claims, 83 (20.5%) resulted in an indemnity payment and 15 (3.7%) resulted in a payment exceeding $1 million. Annual rates of indemnity were lower among pediatricians (0.5%) than other physicians (1.6%, P < .001), whereas rates of payments exceeding $1 million were similar (0.13% among pediatricians and 0.11% among other physicians, P = .57). The mean indemnity payment was $562 180 (SD $667 962). Cases with permanent injury (n = 172) had larger mean payments ($703 373) compared with fatalities ($559 102; n = 131) or temporary or psychological injuries ($127 663; n = 101), P < .05. The mean time to resolution was 23.4 months (SD 21.8 months).

CONCLUSIONS

Indemnity payments among pediatricians are infrequent but large, particularly in cases with permanent patient injury rather than death or temporary injury. The time required to resolve claims may be considered to be long.

The Welfare Effects of Medical Malpractice Liability

We use variation in the generosity of local juries to identify the causal impact of medical malpractice liability on social welfare. Growth in malpractice payments contributed at most 5 percentage points to the 33% total real growth in medical expenditures from 1990-2003. On the other hand, malpractice leads to modest mortality reductions; the value of these more than likely exceeds the costs of malpractice liability. Therefore, reducing malpractice liability is unlikely to have a major impact on health care spending, and unlikely to be cost-effective over conventionally accepted values of a statistical life.

Patients value metastatic cancer therapy more highly than is typically shown through traditional estimates

There is a growing emphasis on promoting medical treatments that provide the most benefits relative to their costs. However, objective criteria for determining the value patients receive from treatment are lacking. This study used data on the treatment choices of terminally ill patients to estimate the value they associate with care. We found that patients place high valuations on metastatic cancer therapy--on average, twenty-three times higher than its cost--and that other traditional methods used to estimate the value of these treatments for patients significantly undervalues how patients view them. Our methods provide another framework for an evidence-based approach to assessing the value of treatments for terminal illness.

The Frequency, Severity, and Economic Consequences of Musculoskeletal Injuries to Firefighters in California

The most common work-related injuries among firefighters are musculoskeletal disorders (MSDs). The strict physical demands of the job and limited modified work opportunities suggest that MSDs are potentially more disruptive and costly to firefighters than to others. The importance of understanding the frequency and severity of firefighter MSDs has become heightened due to changes to the California workers' compensation landscape since 2004, including the reduction of permanent-disability ratings that occurred due to the adoption of a new disability rating system and new rules for apportioning disability with respect to job-related causation, the adoption of treatment guidelines to provide utilization review in workers' compensation medical care, and the imposition of caps on the number of times injured workers can be reimbursed for use of chiropractic care and physical therapy. Each of these could have a potentially disadvantageous and disproportionate impact on firefighters with MSDs. This article describes the average frequency and severity of work-related MSDs experienced by California firefighters; examines the impact of work-related MSDs on the firefighters' earnings and employment several years after injury; evaluates the reforms' impact on the ratings of firefighters with permanently disabling MSDs; and assesses whether reforms to the medical delivery system affected the employment outcomes of firefighters with MSDs.

Workplace injuries and the take-up of Social Security disability benefits

Workplace injuries and illnesses are an important cause of disability. State workers' compensation programs provide almost $60 billion per year in cash and medical-care benefits for those injuries and illnesses. Social Security Disability Insurance (DI) is the largest disability insurance program in the United States, with annual cash payments to disabled workers of $95 billion in 2008. Because injured workers may also receive DI benefits, it is important to understand how those two systems interact to provide benefits. This article uses matched state workers' compensation and Social Security data to study the relationship between workplace injuries and illnesses and DI benefit receipt. We find that having a lost-time injury substantially increases the probability of DI receipt, and, for people who become DI beneficiaries, those with injuries receive DI benefits at younger ages. This relationship remains robust even after we account for important personal and work characteristics.

The Growth Of Physician Medical Malpractice Payments: Evidence From The National Practitioner Data Bank

We used data from the National Practitioner Data Bank (NPDB) to study the growth of physician malpractice payments. Judgments at trial account for 4 percent of all malpractice payments; settlements account for the remaining 96 percent. The average payment grew 52 percent between 1991 and 2003 (4 percent per year) and now exceeds dollar 12 per capita each year. These increases are consistent with increases in the cost of health care. A preoccupation with data on judgments, extreme awards, or specific specialties results in an incomplete understanding of the growth of physician malpractice payments.
