Systematic review of the prevalence, impact and mitigating strategies for bullying, undermining behaviour and harassment in the surgical workplace

Sexual assault and harassment of doctors, by doctors: a qualitative study

CONTEXT

Although sexual harassment frequently occurs in medical education and medical workplaces, doctors who have been sexually harassed or assaulted by other doctors remain a largely invisible population. This study aimed to identify, using personal accounts, the impact on doctors of sexual harassment and assault by doctors in the workplace.

METHODS

This narrative study used in-depth interviews, legal reports and victim impact statements, tracing trajectories from the event's pre-history to its aftermath and impact on professional practice. Participants were six Australian women doctors who had been subjected to one or more non-consensual sexual acts through coercion or intimidation by another doctor in their working environments, within hospital training programmes.

RESULTS

All women identified long-term personal and professional impacts of their experience. Three women had never reported the abuse. The meaning and impact of sexual abuse for the doctors followed a trajectory with discrete phases: prelude, assault, limbo, exposure and aftermath. Discounting the event and its impacts, and returning to the workplace were characterised as 'being professional'. Those who sought legal restitution said it damaged their personal well-being and their standing among fellow doctors.

DISCUSSION

Understanding the phases of experience of abuse enables the development of effective interventions for different phases. Interventions to minimise the risk of occurrence of sexual abuse must be distinguished from interventions to increase reporting rates, and interventions to mitigate harm and impact on victims' futures. Idealised notions of professionalism can act as obstacles to doctors responding to sexual abuse.

Legal perspectives on black box recording devices in the operating environment

Background

A video and medical data recorder in the operating theatre is possible, but concerns over privacy, data use and litigation have limited widespread implementation. The literature on legal considerations and challenges to overcome, and guidelines related to use of data recording in the surgical environment, are presented in this narrative review.

Methods

A review of PubMed and Embase databases and Cochrane Library was undertaken. International jurisprudence on the topic was searched. Practice recommendations and legal perspectives were acquired based on experience with implementation and use of a video and medical data recorder in the operating theatre.

Results

After removing duplicates, 116 citations were retrieved and abstracts screened; 31 articles were assessed for eligibility and 20 papers were finally included. According to the European General Data Protection Regulation and US Health Insurance Portability and Accountability Act, researchers are required to make sure that personal data collected from patients and healthcare professionals are used fairly and lawfully, for limited and specifically stated purposes, in an adequate and relevant manner, kept safe and secure, and stored for no longer than is absolutely necessary. Data collected for the sole purpose of healthcare quality improvement are not required to be added to the patient's medical record.

Conclusion

Transparency on the use and purpose of recorded data should be ensured to both staff and patients. The recorded video data do not need to be used as evidence in court if patient medical records are well maintained. Clear legislation on data responsibility is needed to use the medical recorder optimally for quality improvement initiatives.

Canadian Association of Pediatric Surgeons' state of wellness

The following is a summary of the fourth Ein Panel Debate Session from the 50th Annual Meeting of the Canadian Association of Pediatric Surgeons (CAPS) held in Toronto, ON, from September 26-29, 2018. The session focused on surgeon well-being at different stages of career: role of mentorship at the start of career, second victim syndrome, litigation stress syndrome, and retirement. Using Maslach Burnout Inventory Survey, CAPS members were presented their wellness scores as a group compared to other health care providers. The power of surgical culture in influencing decision making and judgment was explored. A culture shift toward vulnerability and transparency is possible and more suitable to expert practice and surgeon wellness.
