Over a decade of research on children's eyewitness testimony: what have we learned? Where do we go from here?

Developmentally Sensitive Forensic Interviewing of Preschool Children: Some Guidelines Drawn From Basic Psychological Research

Interviewing preschool children who are victims or witnesses of crime to ensure accuracy and completeness of their recall is no easy task. Rising up to the challenge, a large number of empirical psychological studies related to interviewing young children have been conducted in the past decades. Most of these studies were applied research, simulating circumstances of real forensic interviews. It is believed, however, that more basic research could also be informative. The present article thus selectively reviews more basic psychological research in the areas of memory development, language development, and conceptual development as they relate to the forensic interviewing of preschool children. Based on characteristics of preschool children’s development in these areas, some useful guidelines are generated for forensic interviewers. Recommendations for future research are also made.

Reliability of Children's Testimony in the Era of Developmental Reversals

A hoary assumption of the law is that children are more prone to false-memory reports than adults, and hence, their testimony is less reliable than adults'. Since the 1980s, that assumption has been buttressed by numerous studies that detected declines in false memory between early childhood and young adulthood under controlled conditions. Fuzzy-trace theory predicted reversals of this standard developmental pattern in circumstances that are directly relevant to testimony because they involve using the gist of experience to remember events. That prediction has been investigated during the past decade, and a large number of experiments have been published in which false memories have indeed been found to increase between early childhood and young adulthood. Further, experimentation has tied age increases in false memory to improvements in children's memory for semantic gist. According to current scientific evidence, the principle that children's testimony is necessarily more infected with false memories than adults' and that, other things being equal, juries should regard adult's testimony as necessarily more faithful to actual events is untenable.

Theoretical and forensic implications of developmental studies of the DRM illusion

In the study of false memory, developmental research on the Deese-Roediger-McDermott (DRM) illusion has played a pivotal role in theory evaluation and forensic application. The extensive developmental DRM literature (55 experiments published in English-language journals) provided the first clear evidence that false memories can increase dramatically from early childhood onward, whereas traditional ideas about cognitive development predict steady declines. Similar increases have recently been reported in false memory for complex, realistic life events, using forensically oriented paradigms. Age improvements in the ability to connect meaning across words have been found to be necessary and sufficient for developmental increases in the DRM illusion. When the data of developmental DRM studies are combined with parallel findings from forensically oriented paradigms, the result is an existence proof that a principle used by the law to evaluate children's evidence is mistaken. According to that principle, children's versions of events are always more likely to be infected with false memories than those of adults, and hence, juries should give more weight to adults' versions of events.

Developmental reversals in false memory: Effects of emotional valence and arousal

Do the emotional valence and arousal of events distort children's memories? Do valence and arousal modulate counterintuitive age increases in false memory? We investigated those questions in children, adolescents, and adults using the Cornell/Cortland Emotion Lists, a word list pool that induces false memories and in which valence and arousal can be manipulated factorially. False memories increased with age for unpresented semantic associates of word lists, and net accuracy (the ratio of true memory to total memory) decreased with age. These surprising developmental trends were more pronounced for negatively valenced materials than for positively valenced materials, they were more pronounced for high-arousal materials than for low-arousal materials, and developmental increases in the effects of arousal were small in comparison with developmental increases in the effects of valence. These findings have ramifications for legal applications of false memory research; materials that share the emotional hallmark of crimes (events that are negatively valenced and arousing) produced the largest age increases in false memory and the largest age declines in net accuracy.

Juror perceptions of child eyewitness testimony in a sexual abuse trial

A mock child sexual abuse trial was used to study juror perceptions of child eyewitnesses. The child's age (5, 11, or 16) and level of involvement (victim or bystander) were varied across conditions in order to test their impact on juror perceptions and verdict. Results indicated a significant effect of level of involvement on the verdict; defendants in trials involving a bystander witness received higher guilt ratings than defendants in trials with a victim-witness. In addition, jurors perceived the child's eyewitness testimony to be more believable when the child was younger. Implications for the impact of these findings on real-life child sexual abuse cases are discussed.

Updating reactivated memories in infancy: II. Time passage and repetition effects

Previous attempts to modify a reactivated memory by passively exposing infants to a novel cue immediately after reactivation were unsuccessful. Presently, we examined other conditions in which passive exposure to a novel cue immediately after reactivation might modify the memory. In three experiments, sixty-two 3-month-olds learned to move a distinctive mobile by kicking, forgot the training memory, and then received a reminder that reactivated it. Immediately afterward, they were passively exposed to a novel mobile. We found that passive exposure to novel information could modify reactivated memories that were older or had been reactivated before. Although exposure to a novel mobile occasionally produced only retroactive interference, memory modification never occurred alone, suggesting that response suppression to the original cue is prerequisite for the modification of reactivated memories. We propose that memory distortion (modification) is not an anomaly but is an adaptive, updating mechanism that ensures that behavior will be guided by memories containing contemporaneous information.

Reducing child witnesses' false reports of misinformation from parents

This study explored whether a source-monitoring training (SMT) procedure, in which children distinguished between events they recently witnessed versus events they only heard described, would help 3- to 8-year-olds to report only experienced events during a target interview. Children (N = 132) who witnessed science demonstrations and subsequently heard their parents describe nonexperienced events received SMT before or after a forensic-style interview. SMT reduced the number of false reports that 7- and 8-year-old children reported in response to direct questions but had no impact on the performance of younger children. Combined with earlier results, these data suggest a transition between 3 and 8 years of age in the strategic use of source-monitoring information to support verbal reports, such that only 7- and 8-year-olds generalize training to a difficult memory task that does not include mention of specific alternative sources.

Toward a psychology of memory accuracy

There has been unprecedented interest in recent years in questions pertaining to accuracy and distortion in memory. This interest, catalyzed in part by real-life problems, marks a significant departure from the quantity-oriented approach that has characterized much of traditional memory research. We outline a correspondence metaphor of memory underlying accuracy-oriented research, and show how the features of this metaphor are manifested across the disparate bodies of research reviewed here. These include work in the Gestalt tradition, spatial memory, memory for gist, schema theory, source monitoring, fluency misattributions, false recall and recognition, postevent misinformation, false memories, eyewitness research, and autobiographical memory. In examining the dynamics of memory accuracy, we highlight the importance of metacognitive monitoring and control processes. We end by discussing some of the methodological, theoretical, and metatheoretical issues inherent in accuracy-oriented research, attempting to prepare the groundwork for a more coherent psychology of memory accuracy.
