Exploring the influence of reporting delay on criminal justice outcomes: comparing child and adult reporters of childhood sexual abuse

The Effect of Delayed Reporting on Mock-Juror Decision-Making in the Era of #MeToo

The #MeToo movement has given voice to victims of sexual harassment and assault. In many of these cases, there have been long delays in reporting of the sexual offence (e.g., the Harvey Weinstein case). The purpose of this study was to examine how the type of sexual offence (harassment vs. assault) and the length of delayed reporting (15, 25, 35 years) influenced mock-juror decision-making. Mock-jurors (N = 319) read a mock trial transcript depicting an alleged sexual offence and were asked to render a dichotomous verdict, continuous guilt rating, and defendant and victim perception ratings. The data indicated an effect of sexual offence type such that mock-jurors held more favorable perceptions of the defendant when the alleged offence was harassment compared with assault. There also was an effect of delayed reporting such that mock-jurors rendered more guilty verdicts when there was a 25-year delay compared with a 15-year delay. Intriguingly, these results suggest that jurors in sexual offence cases may perceive longer delays in reporting as more believable than shorter delays.

Predictors of Prosecutorial Decisions in Reports of Child Sexual Abuse

A retrospective examination of 500 child sexual abuse reports to prosecutor's offices analyzed case progress and predictors of attrition, including details about alleged perpetrator(s), victim(s), their families, and other case characteristics. Less than one in five cases proceeded to prosecution. For the full sample, we describe all outcomes and differentiate prosecutors' decisions to (a) intake/close, (b) investigate/close, or (c) prosecute; these stages comprise a 3-level dependent variable. Because it is important to understand which variables are associated with progress to each stage, we examined unique predictors of the decision to "investigate," and to "prosecute." Our multivariate analyses examine 325 cases with a perpetrator aged 16 and older. Caregiver support and perpetrator age were significant predictors across all outcome variables, while other factors were barriers to the "prosecute" decision only. Results highlight the complexities of case characteristics that are important at different stages of prosecutorial decision-making and inform future interventions.

'Cold feet': The attrition of historic child sexual abuse cases reported to the police in a Northern Canadian Territory

BACKGROUND

Most previous sexual assault attrition research has not differentiated between cases reported promptly and non-recent (or historic) reports, obscuring differences in attrition patterns. Historic child sexual abuse [HCSA] presents challenges for investigation and prosecution, including a lack of physical evidence, and complainant and witness memory issues.

OBJECTIVE

To determine attrition patterns and analyze complainant reasons for withdrawal in HCSA cases in a region with a large Indigenous population.

SAMPLE AND SETTING

This study examined 231 non-institutional HCSA complaints reported to the police in a Northern Canadian Territory.

METHODS

Files were coded for a range of complainant, suspect, and offence variables. Reasons given by complainants were examined using thematic analysis. Logistic regression was performed, looking for factors connected with complainants' likelihood of continuation.

RESULTS

Overall attrition was 68.8%, with 159 cases not resulting in convictions. The leading cause of attrition, at 39.6%, (n = 63) was initiated by complainants, many of whom withdrew during the early stages of the investigative process. Thematic analysis of reasons for complainant withdrawal yielded two main themes ('cold feet' and 'therapeutic'). Logistic regression results showed that three complainant-related variables were significant [p = 0.001] for complainant continuation: multi-complainant cases; previous disclosure by complainants; and complainant age (15-17 years old) at offence.

CONCLUSIONS

Results showed less attrition overall than for recent sexual assault, and highlighted the need to support HCSA complainants from early in the process, especially those reporting abuse for the first time. It was also found that some complainants were satisfied without going to court.

How Do Childhood and Parental Anxiety Features Affect the Consequences of Child Sexual Abuse?

The purpose of the study was to investigate the anxiety features of children who experience child sexual abuse (CSA) and their parents, along with the features and consequences of sexual abuse in the environment of Child Advocacy Centers (CAC). The sample of this study comprised 150 children affected by CSA and one of their parents who were admitted to İzmir CAC between June 2016 and November 2016.The children-age range 9 to 13 years-and one of their parents were asked to complete the State-Trait Anxiety Inventory separately. The children also completed the Childhood Anxiety Sensitivity Index (CASI). During psychiatric evaluations of the children, sociodemographic characteristics and features of sexual abuse were noted and all psychiatric conditions were examined. The statistical analyses yielded significant correlations between the STAI scores of the parents and STAI-C and CASI scores of the children. There were statistically significant differences between the CASI scores, STAI-C subscale scores, and STAI subscale scores according to some variables of CSA along with their psychiatric diagnosis. Our findings showed that having higher anxiety sensitivity and trait anxiety levels and having parents with higher trait anxiety might be considered as risk factors for being diagnosed as having a psychiatric disorder due to CSA.

Fourteen-Year Trends in the Criminal Justice Response to Child Sexual Abuse Reports in New South Wales

This study of attrition compares the prosecution of child sexual offenses reported while the complainant was still a child with those in which the report was delayed into adulthood; it also compares matters involving adult and young (under 18 years) suspects/defendants. It is based on an analysis of police and court administrative data in New South Wales, Australia over a 14-year period (2003-2016). Only one in five (21.6%) proceeded beyond the investigation stage. Criminal proceedings were more likely to commence when the alleged victim was 7-12 years old at the time of the incident, when the suspect was an adult and at least 10 years older than the victim, and also when the report to police was made when the victim was an adult. Just over half (55.5%) of the matters finalized in court resulted in a conviction. Cases in the higher courts were less likely to be dismissed and more likely to feature guilty pleas and convictions at trial than cases in the lower courts. The overall estimate is that only 12% of offenses reported to police resulted in a conviction, at a relatively stable rate over 14 years. These findings are consistent with those of comparable studies.

The characteristics of reports to the police of child sexual abuse and the likelihood of cases proceeding to prosecution after delays in reporting

Delays in disclosing and reporting child sexual abuse to the police are common, particularly among males and those who have been abused by clergy and others in a position of trust. This study, commissioned by the Royal Commission into Institutional Responses to Child Sexual Abuse, examined the patterns of timely and delayed reporting of sexual offences against children, and the likelihood of legal action commencing. De-identified unit record data for all sexual offences against children reported to the police over 20 years were obtained from official crime statistics agencies in two Australian states. While there were similarities between the two states in terms of the influence of public inquiries on reporting numbers over this period, and in the factors associated with delayed reporting, there were substantial differences in the likelihood of legal action being taken in cases reported by a child or adult complainants. In one state, legal action was more likely with increasing delay, until the delays extended to 10-20 years, after which the likelihood of legal action decreased. In the other state, the pattern was quite different - reports of sexual assault were somewhat more likely to result in legal action with immediate reporting. The least likely to proceed were cases involving young children in more recent years; long delays into adulthood were not necessarily adverse for prosecution.

The Place of Culture and Religion in Patterns of Disclosure and Reporting Sexual Abuse of Males: A Case Study of Ultra Orthodox Male Victims

This article deals with reporting patterns of sexual abuse in males in a religious-cultural context through a case study of ultra-Orthodox Jewish (Haredi) men who were young victims of sexual abuse. The study is based on in-depth interviews with 40 Haredi men. The results indicate that sexual abuse involving ultra-Orthodox boys was and is underreported. Moreover, the results indicate that even when such incidents were reported, the avenues for disclosure were parents, educational-religious figures, and friends. It was also found that silencing in matters related to sexuality, viewing sexual abuse in boys as a serious sin and taboo, and encouraging blind obedience-all of which characterize Haredi society-were factors in the underreporting. The results also show a strong tendency to cover up incidents of sexual abuse on an individual level, on a family level, and at the community level. The findings indicate a linkage between the religious and cultural background of male victims of sexual abuse and their reporting patterns.

Young Victims Telling their Stories of Sexual Abuse in the Emergency Department

Among young children, child sexual abuse is a common type of maltreatment. Child sexual abuse (CSA) is an important national public health problem that has a devastating impact on the emotional and psychological makeup of the child, family, and society. The purpose of this analysis is to explore the young victim's own stories of disclosure of child sexual abuse and is an exploratory case study using reported assault histories of victims of CSA between the ages of 6 and 14, taken in the immediate wake of the assault. The data were extracted from the hospital records of child victims treated in an emergency department between 2006 and 2010. This qualitative research, using thematic analysis, explored the stories of sexual abuse for children as told by them. Two themes emerged regarding the experience of sex abuse and the immediate outcomes on the children: (1) Abuse Circumstances, which included the child's level of awareness of child sexual abuse, predisposing factors, and the perpetrator's preparation (physical, behavioral, and verbal tactics), and (2) Physical/Psychological Suffering associated with disclosure. These have important implications for all service and health care providers.
