Scenarios of social isolation during the first wave of the COVID‐19 pandemic in Rio de Janeiro, Brazil

This work analyses the construction of social isolation as a public problem during the first wave of COVID‐19, drawing on experiences in Rio de Janeiro which, in addition to being one of the country’s major cities, had among the highest mortality rates in Brazil in 2020. We consider both the legal measures enacted by government agencies to contain the contagion and media coverage on the effects of these measures at the local level. The results show that, in the absence of compulsory confinement measures, urban public spaces were deployed both by government agencies and the media in a process by which social isolation was framed as a public problem. Legal measures affected daily patterns of movement, mobility, and sociability, and intervened in the dynamics of central urban functions and in access to and use of public spaces. Media reports gave voice to levels of public agreement or disagreement with regulations and emphasised the significance of legal measures to contain the spread of the virus. Public spaces are at the core of debates about compliance with legal measures to enforce social isolation because they are privileged places where social issues become visible and problematic material expressions of relationships between citizens and the law.

Courtwatching: Visibility, publicness, witnessing, and embodiment in legal activism

Courtwatching involves grassroots efforts to observe the day-to-day work of decision making in justice systems, usually undertaken by activists as a way to scrutinise and challenge the power of legal professionals such as judges. This paper argues for closer attention to courtwatching in legal geographical research. Numerous courtwatching programmes exist around the world, and the first part of the paper surveys some of these, giving a sense of their diversity, the challenges they can face, and the influence that they have. The second part of the paper uses courtwatching to explore questions of visibility, publicness, witnessing, and embodiment in legal research into courts, trials, and hearings. It argues that courtwatching highlights the complexity of legal publicness, problematising the binary notion of "closed" or "open" hearings, and also raises important questions about the ethical differences between watching and witnessing. Finally, in the context of proliferating ways in which courts are becoming public via digital means of watching, such as TV and podcasts, the paper asks what difference it makes to actually be there, in the flesh, to watch legal processes.

We have never been so bounded: Pandemic, territoriality, and mobility

In this intervention, I examine the bordering dynamics in the nomosphere configured by the global pandemic crisis and their territorial consequences, drawing on an autoethnography of the impact of bordering on everyday life and academic practices. On the one hand, I rely on my observation of Switzerland, and Europe in general, to discuss the bodily and everyday experiences with borders at different scales; on the other, as a British National (Overseas) passport holder in an attempt to get access to Taiwan for doing fieldwork, I document the difficulties in dealing with the border control, showing how the influence of geopolitics and contested identities on the research praxis is complicated by bordering during the pandemic. These legal geographies of territoriality demonstrate that borders are not only constantly becoming and fluid, but also more discursively present and materially visible during the pandemic than other times. The work of bordering, I argue, produces an uneven geography which deserves our attention.

Regulating epidemic space: the nomos of global circulation

After the Severe Acute Respiratory Syndrome (SARS) outbreak in 2002, legal theorist David Fidler diagnosed the arrival of the 'first post-Westphalian pathogen'. The coinage indicates that the spread of infectious disease transforms the spatial coordinates of the modern political environment. This article analyses this transformation by asking how the legal regime, designed to prepare for the pandemic, envisions the globe as an object of government. It demonstrates that the WHO's International Health Regulations (IHR) articulate a space of global circulation that exhibits two features. First, the infrastructures of microbial traffic become the primary matters of concern. The IHR do not focus on human life so much as they aim at securing transnational mobilities. Second, the IHR circumscribe a space that is fragmented by zones of intensified governmental control at transportational nodal points, such as airports and harbours. In these zones, technologies of screening and quarantine are applied to modulate the connectivity of people, organic matter and things. As a whole, the article investigates how processes of de- and re-territorialisation interact in the context of global health security. In analysing forms of legal worldmaking, it unearths a nomos of global circulation which applies its regulatory force to the post-human materialities of microbial traffic.
