How (Not) to Break Up: Constituent Power and Alternative Pathways to Scottish Independence

In October 2022, the UK Supreme Court unanimously held that the Scottish Parliament lacks the power to legislate for a second referendum on Scottish independence (Indyref 2) absent an enabling Order by the UK government under section 30 of the Scotland Act 1998. With no such Order forthcoming, alternative pathways to Indyref 2 are being investigated. In this article, we examine two such potential pathways-a plebiscitary election and an unauthorised referendum-through the lens of constituent power. We argue that both pathways are theoretically available if one accepts (as we argue) that the Scottish people is the bearer of constituent power. However, we conclude that there are significant obstacles dotting both potential pathways, and as such the only feasible route to internationally recognised statehood for Scotland is via political negotiation.

Scotland and England's colliding nationalisms: neoliberalism and the fracturing of the United Kingdom

This paper explores the growing divide between Scotland and England, a schism that was beginning to take form with Scottish devolution and which has grown exponentially since the Independence Referendum of 2014. The central argument presented in the paper is that renewed impetus for national distinction and self-determination in Scotland is best understood as one facet of a much wider popular disenchantment and growing restiveness with the trajectory of contemporary UK politics, culture and society that has found an outlet via a resurgent nationalist discourse and institutional framework. Analysis here is approached via the application of an original biosocial theory with the aim of presenting further insights into the underlying processes driving contemporary political instability. Moreover, it is argued that this scenario can be understood, and may shed light upon, the wider rise in nationalist and populist sentiment that is contributing to increasing political turbulence across Europe and beyond.

Becoming independent: political participation and youth transitions in the Scottish referendum

Sociological debates on youth engagement with electoral politics play out against a backdrop of supposed 'decline' in civic participation (e.g. Putnam , Norris, ), in turn contextualized by theories of individualization in 'late' or 'reflexive' modernity (Beck, Giddens). However, the enfranchisement of 16 and 17 year olds in the 2014 Scottish Independence Referendum catalysed remarkably high levels of voter turnout among this youngest group, and was accompanied by apparently ongoing political engagement. We explored this engagement among a strategic sample of young 'Yes' voters, in the immediate aftermath of this exceptional political event. Analysis of qualitative interview data generated an unanticipated finding; that interviewees narrated their political engagement biographically, articulated their referendum participation reflexively, and located their new political ideas, allegiances and actions in the context of their own transitions to 'independent' adulthood. This inspired us to rethink young people's political engagement in relation to youth transitions. Doing so enables a synthesis of divergent strands in the sociology of youth, and offers new insights into the combinations of 'personal' agentic and 'political' structural factors involved in young people's politicization.
