Quality of Victim Statement in Child Sexual Abuse in Turkey

Child sexual abuse is the most challenging type of abuse to detect. Moreover, there are difficulties in gathering evidence, apprehending, and prosecuting the perpetrator. The trial is often based on the contradiction of the suspect's and the child's statements. The aim of this study is to identify the difficulties encountered during the entire trial in cases of sexual assault against the child in Turkey starting from the investigation phase, to determine the auditability of taking a child's statement, which is the basis of the judicial decision, and to evaluate the effectiveness of the principles set by the Supreme Court, which oversees the local court decision. It was determined that the trial was continued on abstract allegations, the Supreme Court's approval of the decision of the local court was based on "the slander of a person who wants to harm another person over the sexuality of a minor is contrary to the usual flow of life." Furthermore, the reason wassuggestive of subjective interpretations rather than material truths. This study, which is a master's thesis, has been submitted to the Turkish Ministry of Justice.

Predicting disclosure latency in substantiated cases of child sexual abuse

OBJECTIVE

Children who experience sexual abuse (CSA) often delay disclosure, thus impeding early interventions. This study explores predictors of disclosure latency in a sample of forensically substantiated cases.

METHODS

Court files were analyzed for a total of 124 cases of CSA. The ground truth of the alleged victims' statements had been substantiated by at least one inclusion criterion-an evaluation of the alleged victims' statement as credible by psychological experts applying Statement Validity Assessment (SVA), or the conviction of the suspected offender by the court. Six possible predictors of disclosure latency were tested individually and in a joint negative binomial regression model.

RESULTS

Younger age of the child at abuse onset and intrafamilial (vs. extrafamilial) child-perpetrator relationships (including stepparents) were associated with prolonged disclosure latency. No predictive evidence was found for the child's gender, severity of abuse, or offender's usage of violent or nonphysical strategies to prevent disclosure.

CONCLUSION

This study contributes to understanding the processes of disclosure by reassessing formerly identified predictors of disclosure latency in a sample of forensically substantiated cases. Results are in line with suggestions to further develop effective prevention programs for younger children (e.g., for elementary school) and to explicitly discuss the issue of intrafamilial abuse.

Assessment of Testifying Ability in Preschool Children: CAPALIST

Purpose: Interviews to obtain statements in judicial procedures need to be adapted to the witnesses' abilities to testify. Moreover, knowing the cognitive abilities involved in testifying provides relevant criteria to assess statement credibility. As age or intelligence quotient is not enough to estimate these capabilities, an instrument to evaluate witnesses' specific abilities to testify is needed. The present paper validates CAPALIST, a procedure that considers relevant capabilities when assessing the testimony given by children. Methods: This study analyzed, by means of an invariant measurement approach (Rasch model), four scales included in CAPALIST: language, memory, contextual information, and social thinking. In addition, gender and age differences were analyzed in 83 children [45 males and 38 females; M _age = 4.3 years, SD = 0.74, range (3.06-5.11)] from three courses in early childhood education. Results: The four scales do not severely violate the requirements of the model. The principal component analysis of the residuals indicates that the four scales are one dimensional and that the assumption of local independence was not violated. Differential item functioning of the scales associated with gender was not detected. A significant effect of the school year was obtained, with an increase in ability in successive courses. The percentage of children who presented severe misfit responses with the model was low. In addition, the number of items with a severe misfit was also low. Conclusion: An acceptable performance of CAPALIST is demonstrated for most of the scales, although items with a severe misfit must be replaced, and more difficult items have to be included in some scales of the revised version of the instrument. CAPALIST is a promising procedure to assess the abilities of children to testify in order to adapt interviews and to evaluate their statements correctly.

Avaliação do dano psíquico associado ao depoimento especial

O Depoimento Especial de crianças e adolescentes vítimas de violência sexual vem sendo realizado por psicólogos judiciários. O objetivo deste artigo é discutir um modelo de avaliação psicológica prévia ao depoimento, voltada à ocorrência de danos psíquicos ou revitimização a ele associados. Para tanto, apresenta-se síntese reflexiva da experiência profissional dos autores em processos criminais envolvendo violência contra crianças e adolescentes, debatida à luz da literatura especializada nas áreas da Avaliação Psicológica e Psicologia Forense. Na dimensão intrapsíquica do dano, sugere-se a avaliação de fantasias, ansiedades e mecanismos de defesa da criança associados ao depor. Na dimensão intersubjetiva, aprecia-se seu nível de desenvolvimento cognitivo, raciocínio moral e vinculação ao entrevistador. Observou-se a aplicabilidade das técnicas projetivas temáticas – CAT-A, TAT e Procedimento de Desenhos-Estórias – para avaliar tais constructos, utilizando-se vinhetas clínico-forenses para ilustrar o raciocínio avaliativo. Conclui-se que proteger a criança do processo penal é proteger o próprio processo penal.

Efecto De La Personalidad Sobre El Recobro De Actos Violentos En Testigos

En el campo de investigación en psicología del testimonio se ha estudiado el efecto de múltiples factores psicológicos sobre la cantidad de detalles, la reproducción de conversaciones y las falsas memorias en el recobro de eventos autobiográficos. El objetivo de esta investigación es identificar el efecto de la personalidad sobre el recobro de testigos presenciales de actos con violencia verbal y no verbal. Participaron 40 estudiantes de psicología divididos en cuatro grupos en términos de sus puntuaciones altas en los estilos de personalidad histriónica (Grupo 1), esquizoide (Grupo 2), obsesiva-compulsiva (Grupo 3), y un grupo control con puntuaciones promedio en dichos estilos (Grupo 4). Mediante una situación experimental se presentó a los participantes un video con contenido de violencia verbal o física; posteriormente se realizó una tarea de recobro libre y se evaluó la cantidad de detalles, la reproducción de conversaciones y las falsas memorias. Los resultados mostraron que los participantes del Grupo 1 evidenciaron recobros pobres en detalles, con deficiente precisión en la reproducción de conversaciones y ausencia de falsas memorias, mientras que los participantes de los grupos 2 y 3 recobraron la información con mayor cantidad de detalles y mayor precisión en la reproducción de conversaciones, aunque el Grupo 3 obtuvo la mayor cantidad de falsas memorias. Estos hallazgos son discutidos en términos de la relación entre la forma en que se recobra la información en los procesos de Memoria Autobiográfica en escenarios jurídicos, y que hay otros constructos asociados como la personalidad y la emoción que pueden influir en el testimonio.
