The Environmental Protection Agency in the Early Trump Administration: Prelude to Regulatory Capture

An equity and environmental justice assessment of anti-science actions during the Trump administration

In the United States, science shapes federal health and safety protections, but political officials can and do politicize federal science and science-based safeguards. Many presidential administrations have politicized science, but under the administration of President Trump, these attacks on science-such as buried research, censored scientists, halted data collection-increased in number to unprecedented levels. Underserved communities bore the brunt of the harms. Such attacks disproportionately harm Black, Indigenous, low-income communities, and communities of color, all of whom have long been burdened by pollution exposure and other stressors. We analyze the effects on underserved communities of the Trump administration's anti-science environmental and public health policy actions and offer policy recommendations for current and future administrations. Our goal is to strengthen scientific integrity, prioritize health disparity research, and meaningfully engage affected communities in federal rulemaking.

AnthroShift in a warming world

Thirty years after the UN Conference on Environment and Development created the UN Framework Convention on Climate Change, efforts to respond to the issue continue to be insufficient to meet the challenges of the climate crisis. This perspective builds on the experience of society’s responses to the COVID-19 pandemic to understand what is needed to get to meaningful climate action. It applies the framework of the AnthroShift to assess how transformational social change is likely to emerge. The paper concludes by determining that the most plausible pathway to an effective social response to the climate crisis would be driven by civil society. However, the level of mass mobilization needed is only possible if society is experiencing large-scale and sustained levels of risk that have tangible long-term consequences in terms of social cost to people and property.

The EPA's Commitment to Children's Environmental Health: History and Current Challenges

Children's environmental health (CEH) has a 25-year history at the US Environmental Protection Agency (EPA), during which the agency has advanced CEH through research, policy, and programs that address children's special vulnerability to environmental harm. However, the Trump administration took many actions that weakened efforts to improve CEH. The actions included downgrading or ignoring CEH concerns in decision-making, defunding research, sidelining the Children's Health Protection Advisory Committee, and rescinding regulations that were written in part to protect children. To improve CEH, federal environmental statutes should be reviewed to ensure they are sufficiently protective. The administrator should ensure the EPA's children's health agenda encompasses the most important current challenges and that there is accountability for improvement. Guidance documents should be reviewed and updated to be protective of CEH and the federal lead strategy refocused on primary prevention. The Office of Children's Health Protection's historically low funding and staffing should be remedied. Finally, the EPA should update CEH data systems, reinvigorate the role of the Children's Health Protection Advisory Committee, and restore funding for CEH research that is aligned with environmental justice and regulatory decision-making needs. Regulating Gene Editing in the Wild: Building Regulatory Capacity to Incorporate Deliberative Democracy

The release of genetically engineered organisms into the shared environment raises scientific, ethical, and societal issues. Using some form of democratic deliberation to provide the public with a voice on the policies that govern these technologies is important, but there has not been enough attention to how we should connect public deliberation to the existing regulatory process. Drawing on lessons from previous public deliberative efforts by U.S. federal agencies, we identify several practical issues that will need to be addressed if relevant federal agencies are to undertake public deliberative activities to inform decision-making about gene editing in the wild. We argue that, while agencies may have institutional capacity to undertake public deliberative activities, there may not be sufficient political support for them to do so. Advocates of public deliberation need to make a stronger case to Congress about why federal agencies should be encouraged and supported to conduct public deliberations.

Initiator or Intermediary? A Case Study on Network Relation of Environmental Regulatory Capture in China

Behind the environmental regulatory capture (ERC) lies a complex network of interactions and interests. Identifying the roles of stakeholders in the ERC network and their behavioral motives can illuminate the mechanism of ERC incidents, and provide policy recommendations for reducing other types of regulatory capture. Drawing on the regulatory capture and principal-agent theories, this study develops a triple-layer principal-agent model of environmental regulation practices in China. We further conduct a social network analysis (SNA) on the ERC case in the Environmental Protection Bureau (EPB) of Bobai County, Guangxi Province, China to illustrate the hidden interactions and interest transmission structure among stakeholders in ERC. The results show that the ERC presents obvious characteristics of concealment and complexity, and individual capture often evolves into collective capture. Different stakeholders are in different positions and play different roles in the network. The environmental regulatory authority, the commissioned regulatory agency, and the agency of enterprises form the core power circle of the ERC network, in which the first two play the role of intermediary and the latter acts as an initiator. They together occupy the structural hole position and dominate the evolution of the ERC network. Peripheral structure stakeholders play the role of “bridge” and profit from the expanding ERC network. It is recommended that the principle of decentralization and the balance of power must be taken into consideration. Quantitative analysis methods such as SNA should be applied to clarify accountability when punishing responsible persons. More subjects are also encouraged to participate in environmental regulations and report illegal acts actively. Finally, a blacklist system should be established in the field of environmental protection for regulating the professional and social morality of all parties.

Developing political-ecological theory: The need for many-task computing

Models of political-ecological systems can inform policies for managing ecosystems that contain endangered species. To increase the credibility of these models, massive computation is needed to statistically estimate the model’s parameters, compute confidence intervals for these parameters, determine the model’s prediction error rate, and assess its sensitivity to parameter misspecification. To meet this statistical and computational challenge, this article delivers statistical algorithms and a method for constructing ecosystem management plans that are coded as distributed computing applications. These applications can run on cluster computers, the cloud, or a collection of in-house workstations. This downloadable code is used to address the challenge of conserving the East African cheetah (Acinonyx jubatus). This demonstration means that the new standard of credibility that any political-ecological model needs to meet is the one given herein.

Perspectives from the Society for Pediatric Research: contaminants of water and children's health: Can we do better?

Children are uniquely susceptible to the health consequences of water contamination. In this review, we summarize the existing, robust literature supporting the importance of examining specific water contaminants (i.e., lead, pesticides, nitrates, arsenic, perchlorate) and the routes of contamination in the United States and globally. We also discuss the health effects of exposure to contaminated water and significant disparities related to access to clean water. Lastly, we offer strategies for prevention and intervention-including those focused on the individual patient level-and review the current US policy framework pertaining to regulation of these toxicants. IMPACT: A key message in this article is that exposure to water contaminants have serious and long-lasting consequences on children's health. This review summarizes current existing literature and adds policy recommendations supporting clean water for children. Information from this review has two potential impacts: Guide health professionals in screening and/or treating children's health problems resulting from water contaminant exposure. Guide policy makers in using evidence-based approaches to improve water quality and clean water access.

The End of Resettlement? U.S. Refugee Policy in the Age of Trump

In the past three years, the Trump administration has taken unprecedented actions to slow the flow of refugees to the United States and undermine the foundations of the world’s largest refugee resettlement system. This article considers both the empirical substance of the White House’s anti-refugee policies, as well as their broader theoretical significance as a critical example of the Trump administration’s so-called “administrative deconstruction” agenda. Analyzing refugee policy as a theory-building case study, this article advances a novel argument reframing the administration’s actions through the lens of strategic disruption. Short of systemically deconstructing targeted programs, I contend that the Trump administration is engaged in an improvisational and deliberately antagonistic campaign to upend existing policies for the sake of disruption itself. Ultimately, Trump’s open disregard for established laws and conventions is a distinguishing feature of the administration’s approach, which limits its ability to implement lasting and legally binding change. In the case of refugee resettlement, this approach has produced a series of temporary and highly controversial policies, which have done measurable harm to refugees and humanitarian aid organizations. However, the legal and institutional foundations of the resettlement system remain firmly intact.

Racialized Structural Vulnerability: Neighborhood Racial Composition, Concentrated Disadvantage, and Fine Particulate Matter in California

This study contributes to previous research by advancing a “racialized structural vulnerability” framework and presenting a new empirical analysis of the relationship between neighborhood Asian, Black, and Latinx composition; extrinsic and intrinsic vulnerability; and PM_2.5 exposures in California with secondary data from 2004–2014. Principal component analyses revealed that tract Latinx composition was highly correlated with extrinsic vulnerability (economic disadvantage and limited English-speaking ability), and that tract Black composition was highly correlated with intrinsic vulnerability (elevated prevalence of asthma-related emergency department visits and low birth weight). Spatial lag regression models tested hypotheses regarding the association between Asian, Black, and Latinx population vulnerability factors and the 2009–2011 annual average PM_2.5 percentile rankings, net of emissions and spatial covariates. Results indicated that the percent Latinx population, followed by the regional clustering of PM_2.5, and the percent of non-Latinx Black and non-Latinx Asian population were the strongest positive multivariable correlates of PM_2.5 percentile rankings, net of other factors. Additional analyses suggested that despite shifting demographic and spatial correlates of 2012–2014 PM_2.5 exposures, the tracts’ Black and Latinx composition and location in the San Joaquin Valley remain important vulnerability factors with implications for future research and policy.

DATA RESISTANCE: A SOCIAL MOVEMENT ORGANIZATIONAL AUTOETHNOGRAPHY OF THE ENVIRONMENTAL DATA AND GOVERNANCE INITIATIVE

The dismantlement of evidence-based environmental governance by the Trump Administration requires new forms of activism that uphold science and environmental regulatory agencies while critiquing the politics of knowledge production. The Environmental Data and Governance Initiative (EDGI) emerged after the November 2016 U.S. Presidential elections, becoming an organization of over 175 volunteer researchers, technologists, archivists, and activists innovating more just forms of government accountability and environmental regulation. Our successes include: 1) leading a public movement to archive vulnerable federal data evidencing climate change and environmental injustice; 2) conducting multi-sited interviews of current and former federal agency personnel regarding the transition into the Trump administration; 3) tracking changes to federal websites. In this article, we conduct a "social movement organizational autoethnography" on the field of movements intersecting within EDGI and on our theory, tactics, and practices. We offer ideas for expanding and iterating on methods of public, collaborative scholarship and advocacy.
