Prison Misconduct and the Use of Alternative Resolutions by Correctional Officers in Therapeutic Communities and Other Custody Units

This mixed methods study uses official records and interviews with inmates and staff to compare misconduct in therapeutic communities (TC's) and the use of alternative resolutions (in lieu of formal charges by correctional officers) to other prison units. Prisoner misconduct has been studied using individual self-reports or aggregate prison rates, but unit level differences between TC's and other prison wings are often overlooked. Restorative justice and diversion approaches are much studied in the community corrections literature but correctional officer use of alternatives to charging, such as mediation, is not well understood. The study examines differences in prisoner behavior by unit function by comparing misconduct over a 24 month period in therapeutic communities to general population, worker, protective custody, mental health, and high risk units. Study findings show lower misconduct in TC's, including more serious misconduct such as fights. Furthermore, a significant proportion of overall charges were diverted into alternative resolution (AR)s, particularly within therapeutic communities. Interviewees reported a different approach taken in the TC toward discipline with a greater use of interaction, informal warnings, and application of AR, as opposed to formal charges. Future research is recommended using qualitative research strategies to appraise the alternative resolution decision process and prisoner-staff perceptions of discipline.

Pre-Prison and Indigenous Predictors of Institutional Misconduct

This study prospectively predicted institutional misconduct over a 34-month period using pre-prison factors-intrinsic characteristics an individual brings into prison-stemming from importation theory and indigenous factors-prison environment factors that affect an incarcerated adult-stemming from deprivation theory. Participants were 114 male and female incarcerated adults. Poisson regressions predicting the number of institutional infractions partially supported each of the models tested. Both pre-prison factors of self-regulatory mode and perceived social support were related to infractions but in unique ways. For regulatory mode, locomotion was positively, and assessment negatively associated with misconduct. For social support, perceptions of guidance received within a reliable alliance with others were negatively related to misconduct, whereas perceptions of guidance without that alliance were positively related to institutional misconduct. Of our indigenous factors, sentence length was negatively related to misconduct, whereas custody level was unrelated to misconduct. Implications of the findings and directions for future research are discussed.

MMPI-2-RF Differences Between Violent Offending and Institutional Violence Among Incarcerated Women

The examination of violence perpetrated by female offenders remains an understudied topic, as research typically focuses on male offender samples. As such, it remains unclear what personality characteristics may be associated with the perpetration of violence among female offenders. This study sought to examine the relationship between personality characteristics, as assessed by the MMPI-2-RF, and engagement in violence, within a sample of 228 incarcerated women. Results indicated that women serving time for a violent offense obtained higher mean scores on MMPI-2-RF scales related to underreporting, atypical thoughts/experiences, and paranoia. Women who obtained disciplinary reports for violence within the institution obtained higher mean scores on MMPI-2-RF scales related to behavior/externalizing dysfunction, overactivation, and aggression. Taken together, violence was most strongly associated with the MMPI-2-RF scales related to paranoia and atypical thoughts/experiences (e.g., THD, PSYC-r). This study provides new data on the viability of the MMPI-2-RF to provide critical insights into violent and aggression behavior in female inmates, an understudied population and demonstrate the instrument's efficacy in assessing characteristics associated with violent behavior.

Examining the interplay of attention-deficit/hyperactivity disorder symptoms and trait anger as contributing factors to institutional misconduct among justice-involved adolescents

BACKGROUND

Although justice-involved adolescents have a higher prevalence of trait anger and of attention-deficit/hyperactivity disorder (ADHD) than adolescents in the general population, these factors have not been examined in relation to institutional misconduct.

AIMS

We sought to examine associations between ADHD symptoms and misconduct, including aggression, disruptive behaviours and other rule-violating behaviours among adolescents in a maximum-security residential facility run by the Department of Juvenile Justice and to test the moderating effect of trait anger on such relationships.

METHODS

Archival data collected from April 2010 to May 2011 comprising a resident cohort (N = 119) of justice-involved adolescents (mean age = 16.74) were analysed; 30% were White and 70% Black. Self-report measures of ADHD symptoms and trait anger were collected 2 weeks after their admission to the facility. Behavioural write-ups of rule violations issued by facility staff during the month following the collection of these measures were coded according to the different forms of institutional misconduct.

RESULTS

Analyses revealed that trait anger significantly predicted disruptive behaviours occurring within a 1-month time frame following the administration of the anger measure; it also predicted all other rule violating behaviours except aggression. ADHD symptoms, by contrast, were only marginally predictive. Trait anger did not moderate this small relationship between ADHD symptoms and institutional misconduct.

CONCLUSIONS

These findings that adolescents with a chronic tendency to feel angry are more likely to violate a variety of institutional rules during the first few weeks of admission to a juvenile justice maximum-security residential facility suggest that early intervention efforts are needed to minimise harm within the institution and to prevent these adolescents from continuing on this trajectory, which may affect the conditions of their release.

Interpersonal Violence and Institutional Misconduct in the Los Angeles County Jail System: A Mixed Method Investigation

This study involved a mixed method evaluation of interpersonal violence and institutional misconduct in the Los Angeles county jail system. Interviews with 52 correctional staff uncovered a widely shared belief that AB 109, Prop 47, and the Rosas decision had all contributed to an increase in violence and misconduct in the jail. Analysis of administrative records indicated there was a rise in the monthly rates of these adverse outcomes from 2010 to 2017. Intervention ARIMA models, however, revealed evidence of a statistically significant increase following only the passage of Prop 47. An examination of inmate characteristics across the 8-year observation period confirmed staff suspicions that jail incarcerates with more extensive criminal histories were being confined following the passage of these policies. If jails are to be responsible for confining higher risk inmates, provisions should also be made to increase the availability of evidence-based rehabilitative programming and other treatment services that can help combat the occurrence of these adverse outcomes.

Applying the PAI Treatment Process Index to PAI-As Completed by Adolescents in a Residential Program

The Personality Assessment Inventory (PAI) Treatment Process Index (TPI) is a measure of treatment amenability based on an index of factors related to poor treatment outcomes (e.g., hostility, lack of social support, and poor impulse control). In this study, the formula used to calculate the TPI for the adult PAI was applied to PAI-Adolescent (PAI-As) protoocols completed by 372 adolescents (mean age: 16.8 years; 80% male) during a 22-week residential program for at-risk youth. The number of disciplinary infractions received during the program was used as an indicator of the participants' response to the program. Average PAI-A scale scores and TPI scores were higher than those previously reported for community samples, but lower than those found in clinical samples. TPI scores were positively associated with disciplinary infractions, particularly nonaggressive infractions, when controlling for demographic factors and other clinically relevant variables. Results suggest that the the TPI has relevance for adolescents completing the PAI-A.

Maintaining Safety in the Prison Environment: A Multilevel Analysis of Inmate Victimisation in Assaults

Theoretical models of victimisation emphasise the importance of context. However, few studies have assessed the influence of prison environmental variables on inmate harm in physical assaults. This study used a multilevel model approach to examine individual- and facility-level factors associated with the incidence of assaults among inmates housed at correctional centres in New South Wales, Australia. Results supported proposals that institutional routines and conditions may have an influence on risk. Inmates, who spent less time in employment, were placed in special housing arrangements such as protection, or were located in sites with higher security designations or longer routine hours out of cells were more likely to be harmed in assaults. In addition, more than 40% of variance in assaults was associated with differences across correctional centre sites. We draw on routine activities theory to explain relationships between different prison contexts, provision of guardianship, and exposure to motivated offenders in assault outcomes.

Futurelessness, Risk Perceptions, and Commitment to Institutional Rules Among a Sample of Incarcerated Men and Women

Using self-reported surveys of a sample of 2,927 incarcerated men and women from correctional facilities of varying security levels in the United States, this study explores the interrelationship of futurelessness, perceived certainty and celerity of punishment, and commitment to institutional rules. Incarcerated individuals' commitment to rules with an adult sample has not been explored with consideration to emotionality. Findings suggest that futurelessness and risk perceptions are directly and significantly associated with commitment to institutional rules after controlling for several importation and deprivation factors associated with institutional misconduct. Contrary to the suggestions of prior research, risk perceptions did not mediate the futurelessness-commitment to institutional rules relationship. Direct quotes from study participants are included to contextualize and frame the policy implications of the findings. Theoretical implications and directions for future research are also discussed.

Examining Developmental Patterns of Prison Misconduct: An Integrated Model Approach

Recent prison scholarship has employed an integrated model of the developmental/life-course perspectives and importation model to examine prison misconduct. Using longitudinal data from a large sample of inmates incarcerated in a U.S. prison system, this study attempts to validate and expand recent prison research by systematically examining the relationship among inmate characteristics and misconduct trajectories, particularly for the higher/chronic pattern of misconduct relative to other identified clusters. The results show that smaller groups of inmates have persistent criminal careers and continually engaged in high level of misconduct. In addition, several inmate characteristics associated with prison misconduct can also be useful to distinguishing high-risk inmates/persistent offenders from groups that offend at low rates over time. These findings could provide vital information to prison officials in developing and designing alternative prison services, assistance, and rehabilitation programs based on the misconduct trajectories.

Determinants of Importation and Deprivation Models on Committed Juvenile Offenders' Violent Misconduct: A Taiwanese Perspective

This study draws on theories of importation and deprivation and relies upon self-reported survey data collected in 2015 from 1,045 committed juvenile offenders in Taiwan. Results drawn from Multinomial logistic regressions indicated that among the importation factors, gang membership, volatile temper, and precommitment victimization are significantly associated with violent misconduct. In regard to deprivation factors, longer term of commitment, higher levels of commitment stress, and victimization while committed dramatically increased the levels of violent misconduct, as expected. On the positive side, ongoing support from family and good staff relations significantly reduced the probability of engaging in violent behaviors while confined.

Unpacking Adultification: Institutional Experiences and Misconduct of Adult Court and Juvenile Court Youth Living Under the Same Roof

The present study explores the ability of juvenile waiver policy and the resulting adult court status to impact the experiences and behavior of male youth originating from differing jurisdictions but incarcerated together within state-level juvenile correctional facilities. Using official agency data and youth survey data, this research examines how "adult" status influences behavior for waived youth compared with their juvenile court counterparts. Structural equation modeling and multiple group analysis is used to determine the extent to which adult status moderates the measurement structure of models related to individual characteristics, institutional experiences, and institutional misconduct. Results reveal an improvement in model fit to occur when estimated across the two groups of juvenile court and adult court youth, beyond that which occurs when parameters are constrained to be equal for these two groups. This work reveals adult status to be powerful enough to moderate the effects of who a youth is and what that youth experiences, on how that youth behaves during a term of juvenile incarceration.

Addressing Serious Violent Misconduct in Prison: Examining an Alternative Form of Restrictive Housing

A number of scholars, civil, and human rights activists have expressed concern about the negative impact restrictive housing may have on the physical and mental well-being of inmates. Rigorous, theoretically informed outcome evaluations, however, are virtually nonexistent. Guided by theory and existing empirical evidence, this study explores the future behavioral and mental health outcomes associated with completing an alternative approach to restrictive housing in the Arizona Department of Corrections. To explore program outcomes, we use paired-sample t tests to determine whether post-program behavior is significantly different from preprogram behavior. In addition, we use cross tabulations and independent samples t tests to identify relationships between individual-level inmate and program characteristics and program outcomes. Results from this study suggest that a more therapeutic restrictive status housing program has the potential to improve the future behavior of program graduates; however, future research is needed to build upon these findings.

The relation of borderline personality disorder to aggression, victimization, and institutional misconduct among prisoners

OBJECTIVE

Borderline personality disorder (BPD) is highly prevalent among incarcerated populations; however, research has yet to examine whether prisoners diagnosed with BPD experience greater interpersonal dysfunction and institutional misconduct while incarcerated.

PROCEDURE

This study drew from a sample of 184 male and female prisoners diagnosed with major depressive disorder (MDD) in a randomized trial of depression treatment. The presence of a BPD diagnosis (n = 69) was analyzed as a predictor of disciplinary incidents/infractions (i.e., fights, arguments with staff, disciplinary infractions, isolation), time spent in isolation, and types of aggression and victimization experiences during incarceration.

RESULTS

There was a trend suggesting prisoners with BPD were about twice as likely as those without BPD to report disciplinary incidents/infractions (OR = 1.76 [0.93, 3.32], p = 0.075). Having a BPD diagnosis was unrelated to time in isolation and overall aggression and victimization. However, prisoners with BPD were more likely than those without BPD to perpetrate and be victimized by psychological aggression. Due to high rates of antisocial personality disorder (ASPD) in the sample as a whole (72%), additional analyses compared outcomes across prisoners with no BPD or ASPD diagnosis, BPD diagnosis only, ASPD diagnosis only, and comorbid BPD and ASPD. Prisoners with comorbid BPD and ASPD were no more likely than prisoners with ASPD only to report disciplinary incidents/infractions, but were significantly more likely than those with ASPD only to report perpetrating and being victimized by psychological aggression.

CONCLUSIONS

Among prisoners with MDD, those with a BPD diagnosis have increased risk of psychological aggression and disciplinary infractions during incarceration.

Friendship Group Composition and Juvenile Institutional Misconduct

The present study examines both the patterns of friendship networks and how these network characteristics relate to the risk factors of institutional misconduct for incarcerated youth. Using friendship networks collected from males incarcerated with California's Division of Juvenile Justice (DJJ), latent profile analysis was utilized to create homogeneous groups of friendship patterns based on alter attributes and network structure. The incarcerated youth provided 144 egocentric networks reporting 558 social network relationships. Latent profile analysis identified three network profiles: expected group (67%), new breed group (20%), and model citizen group (13%). The three network profiles were integrated into a multiple group analysis framework to examine the relative influence of individual-level risk factors on their rate of institutional misconduct. The analysis finds variation in predictors of institutional misconduct across profile types. These findings suggest that the close friendships of incarcerated youth are patterned across the individual characteristics of the youth's friends and that the friendship network can act as a moderator for individual risk factors for institutional misconduct.

Coping while Incarcerated: A Study of Male Juvenile Offenders

The present study examines the associations between coping efforts and psychological (internalizing and externalizing symptoms) and behavioral adjustment in a sample of 373 male juvenile offenders (ages 14-17) during the first month of incarceration. Social support seeking was associated with a more rapid decline in internalizing symptoms and lower levels of externalizing symptoms. Acceptance had a stress-buffering effect with regard to internalizing symptoms, whereas denial predicted higher levels of these symptoms. The only coping variable related to violent behavior was active coping, which was associated with lower rates of violent offending among youth with any violent incidents. The importance of fostering coping skills and increasing positive coping options for incarcerated adolescents is discussed.
